Discharging Credit Card Debt
About Credit Card Debt
Credit card debt is considered unsecured debt, meaning it’s not secured by collateral. As a result, the debt is usually discharged in bankruptcy. However, cash withdrawals or purchases on a credit card close to filing a bankruptcy petition may not be dischargeable.
In a Chapter 7 bankruptcy, most unsecured debt is completely forgiven. In a Chapter 13 bankruptcy, a debtor is forced to pay some of these debts over three-to-five years. Once a payment plan is completed, any remaining unpaid balance is discharged.
